Every work industry around the world has numerous discriminations afoot, but many studies have been conducted that highlight challenges faced specifically by women in the workplace. Women face many uphill battles to include differences in pay levels compared with male counterparts; the balance of full-time compared to part-time employment; and the occupational echelons at which women are typically employed. The Equal Opportunities Commission (EOC) reported that ââ¬Å"women remain disadvantaged compared to men, as occupational segregation means they are concentrated in lower skilled and lower paid jobs with less access to vocational training and educationâ⬠(Bimrose, 2004, p. 110). Sexual harassment represents one important instrument for maintaining occupational separation for women in the workplace. Nevertheless, two legislative Acts in the UK that victims can use to confront it are the Sex Discrimination Act (SDA) of 1975 and the Employment Rights Act (ERA) of 1996. Under the SDA, sexual harassment is illegal if it can be construed as sex discrimination and distinguishes between direct and indirect discrimination with sexual harassment identified as a form of direct discrimination. On the other hand, the ERA only applies when an individual has a minimum of 1 yearsââ¬â¢ service with an employer and has been dismissed, resigned or is considering leaving because of harassment (Bimrose, 2004, p. 110). Terms of contract:The terms of e-banking account are set by the ADI and are varied upon notice from time to time. Customers have little bargaining power and also problems with understanding the contractual obligations. To further illustrate this point, there is usually a ââ¬Å"Conditions of Useâ⬠document supplied with a debit or credit card but rarely is it understood, and as soon as the customer signs the card or first uses it, they are deemed to have accepted the card on these conditions. At the relevant time the account was overdrawn in the amount of $67,000. A customer presented to ANZ a cheque in favour of Jakes for $14,000, but, by reason of clerial error, ANZ credited Jakes account with Westpac for $114,000. By the time ANZ notified Westpac for the error, Westpac had applied the money in reducing the overdraft and in honouring a number of Jakesââ¬â¢s cheques. Jakes paid back only $2,500 of the $100,000 before going into liquidation.ANZ brought an action against Westpac to recover the overpayment, however Westpac sought to rely on the defence of ministerial receipt. Bth parties acted on the basis of concessions made by Westpac that the reduction of the overdraft anad the payment of certain cheques which could have been dishonoured by Westpac at the time was notified of the mistake should be ignored for the purposes of determining whether the moneys had been applied. As a result of the concessions it was accepted by Westpac that it had not applied $17,021 of the payment and that it was liable to return this amount. .
